These Terms of Service ("Terms") govern the use of the Hettie app and the website hettie.app (together the "Service"), which are operated by Hettie GmbH ("Hettie", "we", "us").

By registering for or using the Service, you agree to these Terms.

2. Description of the Service

2.1 What Hettie is

Hettie is an information and data infrastructure service. The Service aggregates and structures:

  • Real-time and historical market data
  • Macroeconomic indicators
  • Sentiment analysis from public sources
  • A structured financial knowledge graph
  • Read-only snapshots of positions from brokerage accounts connected by you

This data is made available to the AI model connected by you (e.g. ChatGPT, Gemini, Claude). The AI model, which you operate through your own account with the relevant provider, generates analyses, simulated trades, and suggestions on the basis of this data.

2.2 What Hettie expressly is not

Hettie is not investment advice, financial portfolio management, asset management, or any other investment service within the meaning of Directive 2014/65/EU (MiFID II) or the German Securities Trading Act (WpHG). Hettie is not licensed as an investment firm, tied agent, or financial services institution, and no such licence is required for the Service in its current form.

All displayed trade signals, portfolio suggestions, and commentary are generated by the AI model connected by you, not by Hettie. Investment decisions are made exclusively by you.

3. Formation of the contract

3.1 Registration

To use Hettie you need an account. You may register if you:

  • have reached the age of 18 and have full legal capacity,
  • are resident in a country in which Hettie is offered, and
  • do not use the Service on behalf of a third party or for commercial purposes.

The contract of use is formed upon successful confirmation of your registration.

3.2 Pro subscription

For the paid Pro plan, a separate subscription contract is formed once you click the "Order with obligation to pay" button and we confirm your order.

4. Plans and prices

4.1 Free

The basic service is free and available for an unlimited period. The scope of features may change over time.

4.2 Pro

The Pro plan costs €12 per month. All prices include applicable statutory VAT.

4.3 Trial period

New Pro users may try the service free of charge for 14 days. The trial period ends automatically; if it is not cancelled before it ends, it transitions seamlessly into the paid subscription.

4.4 Term and renewal

The Pro subscription has a term of one month and renews automatically for one further month at a time, unless cancelled by the end of the respective term.

4.5 Price changes

We may adjust prices for future billing periods. We will notify you of any price changes by email at least 30 days before they take effect. In that case you have the right to cancel the subscription with effect from the date the price change takes effect.

4.6 Payment

Payments are processed via our payment service provider Stripe. Accepted payment methods are credit card, SEPA direct debit, Klarna, and Apple Pay. In the event of late payment, we are entitled to temporarily suspend access to Pro features.

5. Right of withdrawal for consumers

5.1 Notice of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date on which the contract is concluded.

To exercise your right of withdrawal, you must inform us (Hettie GmbH, Fürstenstraße 19, 80333 Munich, Germany, hello@hettie.app) of your decision by means of an unequivocal statement (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

5.2 Effects of withdrawal

If you withdraw from this contract, we will refund all payments we have received from you without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal.

5.3 Early expiry

If you expressly agree that we may commence performance of the Service (activation of Pro features) before the expiry of the withdrawal period, your right of withdrawal expires, in accordance with § 356(4) of the German Civil Code (BGB), upon full performance of the service.

6. Your obligations as a user

You undertake:

  • to provide truthful information upon registration and to keep it up to date,
  • to keep your access credentials secure and not to share them with third parties,
  • to report any suspicious activity on your account without delay,
  • not to misuse the Service, in particular not:
    • by circumventing technical protection measures,
    • by reverse engineering, scraping, or unauthorised automated access,
    • by overloading our infrastructure,
    • by reselling or commercially redistributing the data provided,
    • by using the Service for unlawful purposes (in particular market manipulation or insider dealing

7. Connected third-party services

7.1 Broker connection

Hettie establishes a read-only connection to your brokerage account via broker APIs or account aggregation services. Hettie cannot at any time initiate trades, transfer funds, or make any other changes to your brokerage account.

Your relationship with your broker is governed exclusively by your broker's terms and conditions. Hettie is not a party to that relationship.

7.2 AI model providers

The connected AI model (ChatGPT, Gemini, Claude) is operated by you via your own account with the relevant provider. That provider's terms of use apply in addition. Hettie has no influence over the quality, accuracy, or availability of the outputs generated by the AI model and accepts no responsibility for them.

7.3 Third-party outages

Hettie depends on third parties (broker APIs, AI providers, data suppliers). Outages, restrictions, or changes on the part of these third parties may affect the availability of the Service and lie outside our sphere of influence.

8. Availability

We strive to ensure a high level of availability of the Service but do not guarantee any specific availability rate. Maintenance, security updates, outages at third-party providers, and force majeure may lead to restrictions.

We will announce scheduled maintenance in advance where possible.

9. Liability

9.1 General

We have unlimited liability for damages arising from injury to life, body, or health, and in cases of intent or gross negligence.

9.2 Ordinary negligence

In cases of ordinary negligence, except in the cases set out in Section 9.1, we are liable only for breaches of a material contractual obligation (cardinal obligation); in such cases our liability is limited to the typical, foreseeable damage.

9.3 Investment decisions

We expressly do not accept liability for:

  • Investment decisions you make on the basis of information displayed in the Service,
  • Outputs of the AI model connected by you,
  • Losses from securities transactions that you execute yourself,
  • Discrepancies between displayed reference prices and the actual execution prices at your broker,
  • Errors, incompleteness, or delays in market data, sentiment signals, or AI analyses.

9.4 Product Liability Act

Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

10. Termination

10.1 Termination by you

You may delete your free account at any time, without notice, via the account settings or by email to hello@hettie.app.

You may cancel the Pro subscription with the notice period set out in Section 4.4, likewise via the account settings or via a cancellation button. The cancellation takes effect at the end of the current billing period.

10.2 Termination by us

We may terminate the contract of use for convenience by giving 30 days' notice to the end of the calendar month.

Extraordinary termination for cause, in particular for serious breaches of these Terms, remains reserved.

10.3 Effects of termination

Upon termination becoming effective, your account data will be deleted in accordance with our Privacy Policy. You may request an export of your data via the account settings until deletion takes place.

11. Changes to these Terms

We may amend these Terms for good cause, in particular in the event of changes in the legal framework, supreme court rulings, technical or economic conditions, or upon the addition of new features.

We will notify you of any amendments by email at least 30 days before they take effect. If you do not object within that period, the amendments are deemed to be accepted. We will specifically draw your attention to this right of objection and its consequences in the notification.

12. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

13.1 Governing law

These Terms and the contract of use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.

13.2 Place of jurisdiction

The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is — provided that you are a merchant, legal entity under public law, or special fund under public law — the registered seat of Hettie GmbH.

13.3 Severability clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
